Abubakar Malami Blasts EFCC for ‘Lawless’ Eviction of His Family

Abubakar Malami has accused the Economic and Financial Crimes Commission (Economic and Financial Crimes Commission) of allegedly evicting his family from their Abuja residence without obtaining a valid court order, describing the action as unlawful and unconstitutional.

In his statement, Abubakar Malami maintained that the operation carried out by EFCC operatives amounted to an extrajudicial exercise of power. He insisted that due legal procedures were not followed, especially as the matter surrounding the property was still subject to judicial review.

The former Attorney-General further argued that no enforcement action should have been taken while the case was still pending in court. According to him, the EFCC’s conduct undermines the principle of rule of law and raises serious questions about due process in property forfeiture matters.

Abubakar Malami questioned the legal foundation used by the EFCC to seal and take over his Abuja residence, stating that an interim forfeiture order does not automatically grant possession rights or authorize eviction of occupants.

He explained that while the anti-graft agency may have obtained a court order relating to forfeiture proceedings, such orders typically require further judicial interpretation before enforcement actions like eviction can be lawfully executed.

According to Abubakar Malami, the EFCC allegedly acted beyond its statutory powers by carrying out a forceful takeover without waiting for a final court directive. He described the action as a dangerous precedent that could weaken public trust in legal institutions if left unaddressed.

Abubakar Malami has called for accountability and judicial scrutiny over the EFCC’s actions, insisting that only a competent court has the authority to determine possession rights in disputed property cases.

He emphasized that the matter is already before the court and urged all parties to respect ongoing legal proceedings rather than resorting to self-help enforcement mechanisms. He warned that such actions could be interpreted as interference with judicial independence.

As the dispute continues, Malami has indicated readiness to pursue all legal remedies available to him. The controversy has further intensified public debate on the powers of anti-corruption agencies and the boundaries of lawful enforcement in Nigeria’s justice system.
