The judiciary, a crucial arm of government, plays a vital role in upholding justice and interpreting laws. However, its effectiveness is often hindered by inadequate welfare packages for judges, a long-standing issue in Nigeria. Despite repeated calls for an independent judiciary, significant progress has only recently been made.
Experts unanimously believe an independent judiciary is essential for democratic governance, ensuring impartial interpretation of laws and serving as a check on the executive and legislative branches. The inadequate welfare packages currently offered to judges undermine their independence, making them vulnerable to external influences. This issue is compounded by the judiciary’s stagnation on the same salary scale for over 16 years, a situation that Minister of Justice and Attorney General of the Federation, Prince Lateef Fagbemi, described as “unacceptable and antithetical to meaningful judicial reform.”
Public Hearings Highlight Need for Judiciary Salary Reforms
The issue of judicial salaries has gained traction, with public hearings providing a platform for key stakeholders to voice their concerns. At a recent hearing on ‘A bill for an Act to prescribe the Salaries and Allowances and Fringe Benefits of Judicial Officeholders in Nigeria and Related Matters Bill, 2024,’ Prince Lateef Fagbemi highlighted the urgent need for reform. He stated, “The present-day reality is that the judiciary has stagnated on the same salary scale for over 16 years; this is unacceptable and antithetical to meaningful judicial reform.”
Justice Kashim Zannah, Chief Judge of Bornu, who represented Chief Justice of Nigeria Olukayode Ariwoola at the hearing, expressed optimism about the proposed reforms. He emphasized that the real beneficiaries of an adequately compensated judiciary are the citizens, who suffer the consequences of a deprived judicial system. “As clearly demonstrated, the real interest under consideration is the interest of these citizens, as they will bear the consequences of a deprived judiciary,” Justice Zannah remarked.
The proposed bill aims to address these disparities by prescribing new salaries and allowances for judicial officeholders. This move is seen as a critical step towards ensuring judicial independence and integrity, ultimately strengthening Nigeria’s justice system and reinforcing public confidence in the rule of law.
Impact of Poor Welfare Packages
The inadequate remuneration of judges and judicial officers significantly exacerbates the challenges confronting the judiciary. Low salaries and insufficient emoluments contribute to brain drain, corruption, and diminished morale among judges, ultimately affecting the quality of justice delivery. According to a report by the National Judicial Council, over 50% of judges have not received a salary increase in the past decade, despite rising inflation and the cost of living. This situation has eroded the sanctity of the judiciary, making judges more susceptible to corruption, which undermines the judiciary’s role as the last hope for the common man and protector of fundamental human rights.
The poor welfare package has resulted in the judiciary losing its independence and becoming easily influenced by the executive arm of government. This influence has rendered the judiciary a mere caricature of its intended role, compromising its ability to deliver unbiased and fair justice. The vulnerability of judges to financial temptations due to inadequate compensation negates the essence of their establishment, challenging the very foundation of democratic governance and the rule of law. The judiciary’s compromised state highlights the urgent need for substantial reforms to restore its integrity and effectiveness.
Government’s Efforts and Commitment
President Bola Tinubu has shown a strong commitment to judicial reform, recognizing the critical importance of an independent judiciary for the health of democratic governance. His administration has taken significant steps to reposition the judicial, including approving a substantial increase in judges’ salaries and emoluments, which are currently undergoing legislative action. Additionally, for the first time in many years, the government has ensured the full complement of 21 Supreme Court Justices, as required by law. These efforts demonstrate a proactive approach to addressing some of the systemic issues plaguing the judiciary.
While the government’s initiatives are commendable, more comprehensive measures are needed to ensure the sustained welfare of judges and judicial officers. A holistic approach to judicial reform should include regular salary reviews and adjustments to account for inflation and the cost of living, alongside improved emoluments and fringe benefits for judges and judicial officers. Enhanced infrastructure and resources for courts and judicial institutions should also be prioritized by the Federal Government to support the efficient functioning of the judiciary. These inclusive measures are essential to restoring and maintaining the independence and effectiveness of the judicial, thereby strengthening the overall governance framework.
