The Peoples Democratic Party (PDP) has taken a firm stand against the defection of 25 former members of the Rivers State House of Assembly to the All Progressives Congress (APC). According to the PDP National Working Committee (NWC), these lawmakers, by virtue of Section 109 (1)(g) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), have vacated their seats and must now prepare for a fresh electoral process.

The PDP emphasizes that there is no remedy available for the defected lawmakers within the party, asserting that they willingly left without meeting the conditions stipulated by the constitution. The PDP’s stance is reinforced by the official declaration of the vacancy of the defected lawmakers’ seats by the Speaker of the Rivers State House of Assembly, Rt. Hon (Barr) Ehie O. Edison DSSRS. This declaration aligns with Section 109 (1)(g) of the Constitution (as amended), making it clear that the seats have become vacant.

The term “Functus Officio” is employed to signify that the assembly has completed its task on the matter, leaving no room for re-admittance of the former lawmakers without a fresh election. This legal standing solidifies the PDP’s argument against any attempts to circumvent the constitutional process.

Caution to Defected Lawmakers

The PDP cautions the 25 former members against false assurances and deceptive hopes that they can return to the Rivers State House of Assembly without undergoing a fresh electoral process.
