Okonkwo Alleges Political Motive Behind El-Rufai’s Continued Detention

A chieftain of the African Democratic Congress, Kenneth Okonkwo, has alleged that the continued detention of former Kaduna State governor Nasir El‑Rufai is politically motivated, claiming it is linked to the former governor’s association with the opposition party.

Speaking during an appearance on Channels Television’s Morning Brief on Friday, Okonkwo criticised the circumstances surrounding El-Rufai’s detention and argued that the situation raises serious concerns about due process and constitutional rights. The lawyer and politician also suggested that the actions of security agencies in the matter reflect a broader political struggle within Nigeria’s evolving party landscape.

El-Rufai has been in custody since February 19 following investigations into allegations of money laundering and abuse of office. His detention has generated debate among political actors and legal observers, particularly regarding the legality and duration of the investigative process.

Allegations of Political Persecution Against El-Rufai

During the interview, Okonkwo alleged that the former governor was being “maltreated and persecuted” because of his recent alignment with the African Democratic Congress. According to him, the situation reflects political tension between the ruling administration and members of the opposition.

Okonkwo also criticised the use of anti-corruption agencies in the investigation, stating that their actions appear to be influenced by political considerations. He suggested that the authority of the presidency could be shaping how the agencies conduct their investigations.

While making the claims, he placed responsibility on the administration of Bola Tinubu, alleging that the instruments of anti-corruption enforcement were being deployed in a way that raises questions about impartiality.

Okonkwo Concerns Over Constitutional Rights and Due Process

The ADC chieftain further argued that detaining a suspect without formally charging them in court contradicts provisions of Nigeria’s constitution relating to fundamental human rights. According to him, suspects should be brought before a court promptly if authorities believe there is sufficient evidence to support criminal allegations.

Okonkwo stressed that security agencies do not have the legal authority to hold individuals indefinitely while investigations continue. He insisted that once a person is arrested, the next legal step should be to file charges and allow the judicial process to determine guilt or innocence.

He added that the responsibility of proving a suspect’s guilt lies with the prosecution, emphasising that a suspect should not be placed in a position where they must prove their innocence before a court has heard the case.

Detention Order and Ongoing Investigation

El-Rufai is currently in the custody of the Independent Corrupt Practices and Other Related Offences Commission after previously being released by the Economic and Financial Crimes Commission. Authorities are investigating allegations related to financial misconduct and abuse of public office during his time in government.

On Wednesday, a magistrate’s court in Bwari granted the anti-corruption agency a fresh 14-day detention order to continue its investigation. The order allows investigators additional time to examine the allegations and determine whether formal charges should be filed.

Members of El-Rufai’s family have criticised the decision, arguing that his continued detention without trial is unjustified. The case has since drawn attention from political actors and legal analysts who are closely monitoring the developments.
