Former Speaker of the Lagos State House of Assembly, Mudashiru Obasa, has taken legal action to challenge his removal from office. Obasa, who was ousted on January 13, 2025, filed a suit at the Lagos State High Court in Ikeja, arguing that his removal was unconstitutional. The suit, lodged on February 14, 2025, names the current Speaker, Mojisola Meranda, and the Lagos State House of Assembly as defendants.
Through his legal team, led by Senior Advocate of Nigeria (SAN) Chief Afolabi Fashanu, Obasa is seeking an order for his immediate reinstatement. He claims that the Assembly had no authority to convene during recess without his authorization or the delegation of such powers. The former Speaker is also requesting an accelerated hearing to prevent further disruptions to the Assembly’s operations.
Political Crisis and Failed Reconciliation Attempts
The removal of Obasa has sparked a political crisis in Lagos, with key stakeholders attempting to mediate a resolution. Multiple meetings have been held in both Lagos and Abuja, with some politicians reportedly aligning with President Bola Tinubu’s stance that Obasa should be reinstated. Despite these interventions, a consensus has not been reached, leaving the crisis unresolved.
Lawmakers loyal to Meranda have resisted calls for Obasa’s return, citing the Assembly’s authority to remove its Speaker. Some members fear that reinstating Obasa could lead to retaliatory measures against those who supported his removal. The prolonged dispute has raised concerns over the stability of legislative governance in Lagos State.
Allegations of Misconduct and Justification for Removal
Obasa’s removal was reportedly driven by allegations of statutory and financial misconduct. The former Speaker faced accusations of misappropriating ₦43.5 billion, allegedly withdrawn for backup vehicles for lawmakers and other questionable expenditures. Critics within the Assembly argued that these financial irregularities justified his impeachment, insisting that due process was followed in his removal.
However, Obasa maintains that his impeachment was politically motivated and lacked constitutional backing. His legal team argues that the Assembly acted outside its jurisdiction by convening without proper authorization during recess. They assert that the impeachment process was rushed and failed to meet the legal standards required for such an action.
Obasa’s Legal Arguments and Court Filing
In the motion filed on February 12, 2025, Obasa’s legal team emphasized that the case should be treated as a matter of urgent public interest. His lawyers argue that legislative activities in the state could be significantly affected if the matter remains unresolved. The suit seeks:
- A declaration that the Assembly’s session on January 13, 2025, was unconstitutional.
- An order setting aside his removal and reinstating him as Speaker.
- A ruling that limits the time within which the defendants can respond to the suit to seven days.
- An order for an expedited hearing to ensure legislative stability in Lagos State.
The legal team has based its arguments on sections of the Nigerian Constitution, including Sections 36, 90, 92(2)(c), and 101, as well as the Lagos State House of Assembly’s Standing Orders. They contend that the impeachment was procedurally flawed and should be overturned.
Uncertainty Over Court Proceedings
As of the time of filing this report, the Lagos State High Court has yet to schedule a date for the hearing. Legal analysts believe that the case could set a significant precedent regarding the powers of state legislatures to remove their leaders, especially during recess periods.
Observers say the court’s decision could have far-reaching political implications in Lagos. If Obasa wins, it could embolden other lawmakers across Nigeria to challenge impeachment proceedings. However, if the court upholds his removal, it may reinforce the Assembly’s authority to discipline its leadership without interference.
For now, Lagos politics remains on edge as the legal battle unfolds. The outcome of this case will determine not only Obasa’s political future but also the stability of the Lagos State House of Assembly.
