In a potentially landscape-altering move, Abubakar Atiku, the Presidential candidate of the Peoples Democratic Party (PDP), has taken his case to the Supreme Court, challenging the decision of the Presidential Election Petitions Court, which declared President Bola Tinubu the victor of the 2023 polls.
Atiku’s 35 Grounds of Appeal
Atiku’s appeal is constructed upon 35 substantial grounds, and it asserts that the tribunal made a grave mistake and miscarriage of justice in its verdict, which dismissed his petition against the Independent National Electoral Commission (INEC)’s declaration of Tinubu as President.
Furthermore, the appeal urges the apex court to set aside the entire findings and conclusions of the Tribunal, as they allegedly do not accurately represent the essence of PDP’s petition.
At the core of PDP’s argument is the claim that the Tribunal failed to uphold the principles of the Electoral Act 2022 by not nullifying the presidential election conducted on February 25, 2023. According to Atiku, the evidence presented demonstrates that INEC conducted the election in which Tinubu became the winner in serious violation of the Electoral Act 2022, going against the doctrine of legitimate expectation. This appeal sets the stage for a legal battle of significant consequence.
