ADC Faults Handling of Malami, El-Rufai Cases, Alleges Selective Justice

The African Democratic Congress (ADC) has criticised what it describes as selective enforcement of the law in the handling of legal proceedings involving two of its prominent members, Abubakar Malami and Nasir El-Rufai.

Both men are currently facing separate legal actions over allegations ranging from corruption and financial misconduct to related offences. While reiterating that no individual is above the law, the ADC expressed concern about what it termed inconsistencies in the application of justice.

In a statement posted on X on Tuesday, the party’s National Publicity Secretary, Bolaji Abdullahi, said the ADC had been closely monitoring developments in the cases and would continue to support its members as they pursue their legal rights.

The ADC stated that although it recognises the authority of law enforcement agencies and the judiciary, it believes the handling of the cases involving Malami and El-Rufai reflects uneven treatment when compared with other high-profile matters.

According to the statement, recent cases involving serious allegations such as passport forgery, international conspiracy, and impersonation resulted in suspects being granted bail while standing trial. The ADC argued that this contrasts with what it described as prolonged custodial movements and inter-agency transfers in the cases involving its members.

The ADC maintained that justice in a constitutional democracy must not only be done but must be seen to be done. It warned that perceived inconsistencies in enforcement risk undermining public confidence in the rule of law.

Presumption of Innocence and Political Neutrality

The party emphasised that Malami and El-Rufai, like all Nigerians, are entitled to the presumption of innocence until proven guilty by a competent court of law. It described both men as “first citizens of Nigeria” whose constitutional rights must be fully respected throughout the legal process.

“As a law-abiding party, it is important to state for the record that the ADC believes no citizen, regardless of stature or past office, is above the law,” Abdullahi said. He added, however, that enforcement actions must be carried out transparently and without political calculation.

The ADC further pledged to stand by its members, stating that it would ensure they are not isolated, intimidated, or denied the protections guaranteed to every Nigerian under the Constitution. The party affirmed its commitment to what it described as fairness, due process, and equal treatment before the law.
