EFCC Successfully Prosecutes Internet Fraudster, Secures Conviction in Lagos Court

The Lagos Zonal Command of the Economic and Financial Crimes Commission (EFCC) achieved a significant legal victory on Thursday, March 21, 2024, as they secured the conviction and sentencing of Ndifreke Okon. The verdict was pronounced by Justice Chukwujekwu Aneke of the Federal High Court in Ikoyi, Lagos. Okon faced a one-count charge related to Internet fraud under Section 22 (3) of the Cybercrimes (Prohibition, Prevention Etc) Act, 2015. He pleaded guilty to the charge, which stemmed from falsely presenting himself as “BINH NGUYEN” on his Instagram account with the intent to deceive and procure financial gain.

During the legal proceedings, prosecuting counsel A.O. Mohammed provided insight into the case through the testimony of investigating officer Mustapha Farouq Umar. Umar detailed Okon’s arrest on December 5, 2023, in Ajah, Lagos, following intelligence regarding the activities of an Organised Cybercrime Syndicate Network (OCSN) operating in the area. Okon admitted to engaging in a dating scam, portraying himself as a white man named Binh Nguyen to unsuspecting victims. Exhibits including an iPhone X, Tecno Spark 5, and HP laptop, recovered during his arrest, were presented as evidence.

Sentencing and Defense’s Plea

Following the presentation of evidence, Justice Aneke declared Okon guilty as charged. In response, defense counsel Oludare Odetoki pleaded for leniency, emphasizing Okon’s status as a first-time offender and displaying remorse for his actions. Odetoki implored the court to consider these factors in sentencing, urging a balanced approach to justice. Despite the plea for leniency, Justice Aneke handed down a sentence of one year imprisonment with the option of a fine totaling N1.5 million and 100 hours of community service.
